Name of the Contest

Namaste India’s Cashback Promo Offer (“Offer”)

Organizing Entity

This Offer is being organized by NIF Private Limited having its registered office at 119-121 (Part), Block P&T, Fazal Ganj, Kanpur, U.P. – 208012 (“NIFPL”).

NIFPL has appointed Premier Sales Promotions Private Limited as their Payment Processing Partner (“BigCity”)

About the Offer

These Terms and Conditions apply to the Offer, under which customers purchasing select NIFPL products — namely, Desi Ghee (450ml and 900ml), Cow Ghee (500ml and 1L) (“Ghee”), Vanilla, Butterscotch, Rajwadi Dry Fruit and American Bites Ice Creams (700ml + 700ml pack) (“Ice Cream”) (Ghee and Ice Cream shall collectively be referred to as “Product(s)”) — shall be entitled to receive an assured cashback (“Cashback”) as follows:

• For 450ml/500ml packs of Ghee: INR 31/- to INR 1100/-
• For 900ml/1L packs of Ghee: INR 51/- to INR 1100/-
• For Ice Cream: INR 31/- to INR 1100/-

The Cashback shall be provided directly by NIFPL.

Additionally, every week, NIFPL shall select one lucky winner from among the customers who have received Cashback on purchase of ONLY Ghee under this Offer, and such winner shall be awarded a 1-GRAM GOLD COIN.

This Offer is subject to the Terms and Conditions stated herein.

Please Note: Products without this Offer are also available in the market. NIF disclaims any liability arising out of or in connection with this Offer or its non-availability, to the fullest extent permitted by law.

Offer Period

The validity of the Offer is as mentioned on the product. Reward (as defined below) must be redeemed within this period to be eligible (“Offer Period”).

Requests for Rewards after the Offer Period will not be credited. NIFPL and BigCity shall not be liable for late or misdirected requests for Reward.

Brand

The Offer promotes the Products under the brand “Namaste India”.

Eligibility for Participants

This Offer is open only to individuals who are residents of India and 18 years of age or older.

The Offer is not open to employees or trade partners (i.e. retailers, dealers, wholesales & distributors of NIFPL or BigCity, government officials, political figures, politically affiliated entities, their immediate families, or anyone professionally connected with this Offer.

“Participant(s)” shall mean any individual who meets the eligibility criteria and requests for a Reward in accordance with these Terms and Conditions.

“Winner(s)” shall mean any individual who as a Participant has received the Cashback and/or 1-GRAM GOLD COIN.

Territory

The Offer is valid pan India, except for the state of Tamil Nadu.

Agreement to Terms

By entering this Offer, the Participant agrees to abide by these terms, conditions and decisions of NIFPL. NIFPL reserves the right to refuse, delete, withdraw, or disqualify any Participant at its sole discretion, without assigning any reason whatsoever.

How to Enter

Participants must purchase the promotional pack of the Product(s). Each eligible pack contains a Cashback voucher code inside the pack.

Participants must scan the QR Code available on the Product and visit the promotional website, complete the registration by providing required details including UPI ID/bank details, and enter the voucher code.

The denomination of the Cashback will be revealed post successful registration.

The Cashback shall be transferred to the registered UPI ID or bank account.

1-GRAM GOLD COIN Winners will be selected randomly from the pool of eligible Cashback recipients of customers who have bought ONLY Ghee Products.

Offer Mechanism

Participants must ensure correct submission of details. Any incorrect, incomplete, or false requests may result in disqualification.

BigCity with written approval of NIFPL reserves the right to restrict Cashback for any account with suspicious behavior or invalid details.

Cashback redemption is subject to applicable taxes.

BigCity with written approval of NIFPL holds the right to refuse Cashback transactions deemed fraudulent. In the event of any fraud detection, NIFPL and BigCity reserves the right to modify/change, discontinue, terminate, withdraw the Offer at any time during the Offer Period.

NIFPL and BigCity shall not be liable for any claim related to the redemption of Cashback or transaction issues.

Rewards

Assured Cashback between

• INR 31/- and INR 1100/- for 450ml/500ml packs of Ghee
• INR 51/- and INR 1100/- for 900ml/1L packs of Ghee; and
• INR 31/- to INR 1100/- for 700ml +700ml pack of Ice Cream

Additionally, every week, one Winner from among the Cashback recipients (ONLY for Ghee) will be selected for a 1-GRAM GOLD COIN.

(collectively referred to as “Reward(s)”)

Participants are eligible to claim assured Cashback Reward for a maximum of 1 purchase of the Product in a week, 2 purchases of the Product in a month, and maximum 8 purchases during the Offer Period i.e. a maximum of 1 voucher can be claimed per user, per mobile number, per week per account (NEFT/UPI) upto a maximum of 2 vouchers in a calendar month and 8 in the promotion duration.

The 1-GRAM GOLD COIN or Cashback Reward is non-transferable, non-refundable, and cannot be exchanged for cash or any other Reward.

Acknowledgement & Disposal of Participation

Requests for Rewards may not be acknowledged and may be destroyed after the Offer Period at the sole discretion of NIFPL. No communication will be entertained regarding requests post the closure of the Offer.

Responsibility of Participant

Winners are required to conduct themselves in full compliance with all applicable laws and regulations at all times.

In case of cash rewards applicable TDS shall be deducted from the Cashback amount before being credited to Winner’s account. In case of non-cash rewards, the Winner shall be bound in order to be eligible to receive the rewards so won, to deposit the applicable amount of taxes/TDS to NIFPL. No non-cash reward shall be released to the Winners unless the applicable TDS is fully deposited.

Each Winner is solely responsible for any and all taxes, fees, or other expenses that may arise in connection with the receipt, use, or enjoyment of the Rewards (if any). NIFPL assumes no responsibility for any such obligations.

Selection of Winner of 1-GRAM GOLD COIN

All Winners will be subject to a lucky draw for the weekly 1-GRAM GOLD COIN Reward. The decisions of NIFPL regarding selection are final and binding.

Notification to the Winners

Winners of the 1-GRAM GOLD COIN Reward must provide identity proof and contact details to claim such Reward. In case any such Winner is unreachable, NIFPL reserves the right to forfeit the Reward or pass it on to another Winner of Cashback (ONLY of Ghee). The responsibility for timely and accurate submission of the information for claiming the Reward rests solely with the Winners. NIFPL cannot be held accountable for any failure to provide necessary or correct information by any Winner.

Delivery of Rewards

Cashback will be credited to the provided UPI ID or bank account post successful registration of the voucher code on the NIFPL reward website. The Cashback will be processed to the UPI ID linked to the mobile number received from the payment gateway partner. No change in mobile number will be permitted once the booking request is submitted, and Cashback will not be issued to any alternate mobile number or UPI ID.

Winners (Cashback received on Ghee) may be required to collect the 1-GRAM GOLD COIN from a designated location or may be required to bear delivery charges if applicable. NIFPL and BigCity shall not be liable for any loss, damage, or delay in transit.

The weekly 1-GRAM GOLD COIN Winner may be required to bear applicable taxes and complete documentation before receiving the Reward. NIFPL and BigCity are not responsible for any incorrect bank details provided by the Winner.

Bank Account

Participants must provide UPI linked bank account or mobile number details while registering only in cases to avail Cashback rewards.

Rights including Intellectual Property Rights in Participation, feedback and data of Participants and Offer.

• 1. The Participant hereby irrevocably assigns, transfers, and conveys to NIFPL and its group companies, without limitation and for the full term of protection (including any extensions or renewals), all rights, title, and interest, including all intellectual property rights, in and to any and all materials, content, or requests submitted in connection with the Offer (including but not limited to name, age, ID Proof, statements, or any other content, collectively, the “Submissions”) with no entitlement to compensation.
• 2. The Participant hereby further agrees and undertakes to do any and all acts and execute any and all documents in such manner and at such locations as may be required by NIFPL in its sole discretion in order to secure, protect, perfect or enforce any of NIFPL’s rights in the Submissions, pursuant to this Offer and/or Terms and Conditions contained herein.
• 3. NIFPL and its group companies shall have the unrestricted right, but not the obligation to use, broadcast, publish, display or otherwise make public the Participant’s details and Submissions on its websites, platforms and through any and all modes, media and formats, whether now known or hereafter developed, as determined by NIFPL in sole its discretion.
• 4. The Participants further relinquish their rights to make any claims or raise any dispute regarding use of their Submissions.

Modification

NIFPL reserves the right to modify or cancel the Offer at any time without prior notice to the Participants.

Use of Submissions for Promotional Purposes

The Participants grant NIFPL and its group companies a royalty-free, worldwide, perpetual, irrevocable, non-exclusive license to use their Submissions for any purposes including but not limited to advertising and promotional purposes in any media worldwide.

NIFPL’s Rights of Editing requests for Rewards

NIFPL reserves the right to edit, alter, or modify the requests for Rewards to ensure compliance with technical specifications and applicable laws.

Social Media Disclaimer

The Offer is not sponsored, endorsed, associated or administered by Instagram, Facebook or any other social media platforms (“Platforms”). Participants irrevocably release and discharge the Platforms from any liability, claims, demands, or cause of action arising out of or in connection with the Offer. All information and materials submitted by the Participants in connection with the Offer are provided solely to NIFPL and not to the Platforms. Participants acknowledge and agree that the Platforms bear no responsibility or liability whatsoever with respect to the administration, conduct, or fulfillment of the Offer.

Application / Platform Disclaimer

The use of any Application / Platform’s name in these Terms and Conditions is only for the purpose of explaining the Terms and Conditions hereof, and does not in any manner confer, assign, or transfer or associate the trademarks or other rights of such payment Application / Platform.

There is no principal agency, joint venture, associate, or any other relationship between the NIFPL and the Application / Platform Voucher, except that both entities have a principal-to-principal relationship.

Agency Role and Liability Exclusion

NIFPL or BigCity accepts no responsibility, financial or otherwise for the misuse of the Rewards and are not liable for any personal loss or injury and cannot be held responsible for any disagreement concerning the quality/ availability of featured Offer. BigCity and NIFPL, its clients, agents, and distributors cannot replace any lost, stolen or damaged Rewards and reserve the right to withdraw or amend any details and/or prices without notice.

BigCity is acting as an executing agency for this promotional Offer and holds no legal and financial liability on unclaimed offers, incentives, Rewards, etc. beyond the applicable Offer Period.

Purity & Certification Disclaimer

The 1-gram gold coin Reward under this Offer shall be of standard purity as available in the market and may be accompanied by a certificate of authenticity from the manufacturer.

NIFPL and BigCity shall not be responsible for the purity, quality, or valuation of the gold coin beyond providing it as per market standards.

Personal Data Protection

Personal data provided by Participants will be collected and processed solely for the purpose of administering the Offer and conducting related promotional activities. Participants shall have the right to request access to, correction of, or deletion of their personal data at any time. Participants hereby agree, acknowledge and consent to NIFPL engaging third-party service providers to process personal data strictly for the purpose of managing and promoting the Offer. NIFPL reserves the right to verify the Participant’s data at any time. The use of Submissions and associated personal data for promotional activities by NIFPL does not constitute a breach of confidentiality. By submitting any information required as part of their participation into the Offer, participants agree to their information being held and processed to the fullest extent permissible as per applicable laws.

Intellectual Property

All intellectual property rights in and to the Offer, its content, and all related materials are and shall remain the exclusive property of NIFPL and/or its group companies. Participation in the Offer does not grant Participants any rights in or to such intellectual property, except as expressly set out in these Terms and Conditions.

Offer Advertising

Offer advertising and marketing may be done on appropriate Platforms determined by NIFPL.

Prohibited Actions and Disqualification

Use of automated systems or tools to participate in the Offer is strictly prohibited. Any attempt to enter the Offer using such automated means may lead to disqualification of the Participant.

NIFPL reserves the right to disqualify any Participant if their actions or information they provide are found to be non-compliant with these Terms and Conditions. To maintain the integrity of the Offer, NIFPL may take necessary actions to protect against fraudulent or invalid claims and requests.

Offer Modification and Termination

NIFPL reserves the right at its sole discretion, to modify, suspend, cancel, or terminate the Offer at any time, including in the event of unforeseen circumstances. If any issues arise that affect the integrity or proper conduct of the Offer, NIFPL may, in its sole discretion, determine Winners of 1-gm Gold Cint based on eligible Winners of Cashback up to the date of such action.

This Offer is subject to promotional availability, is not for sale and applicable government regulations.

Indemnity

Participants hereby release and hold harmless NIFPL from any claims, liabilities, losses, or damages arising out of or related to their participation in the Offer or the acceptance or use of any Rewards. NIFPL assumes no responsibility for any issues arising from Entries, technical failures, network issues, errors in the administration of the Offer, or Participant’s information. Participants further agree to indemnify and hold harmless NIFPL against any claims, demands, or actions arising from or related to their participation.

Force Majeure

NIFPL shall not be liable for cancellation, postponement or modification of the Offer due to events beyond its reasonable control including natural disasters, pandemics, government restrictions, etc.

Language Precedence

In case of conflict between English and any translated version of these Terms, the English version shall prevail.

Limitation of Liability

NIFPL and BigCity shall not be liable for any issues arising from indirect or consequential damages, illegitimate entries, technical failures, errors, or changes in contact information of the Participants. Further, NIFPL and BigCity shall not be responsible for any failure to supply Rewards resulting from circumstances beyond its control and for reasons not attributable to NIFPL and BigCity. Additionally, NIFPL and BigCity are not responsible for any loss or theft of the Rewards. In any event, NIFPL and BigCity’s maximum liability shall not exceed the value of the applicable Reward.

Governing Law

The Offer shall be governed by the laws of Indian, and the courts in Kanpur shall have exclusive jurisdiction to resolve any dispute arising from this Offer for any dispute with NIFPL and the courts of Bangalore for BigCity. Participants hereby submit to the exclusive jurisdiction of courts in Kanpur, India for any dispute with NIFPL and the courts of Bangalore, India for BigCity.

Survival

Notwithstanding the conclusion or termination of the Offer, the provisions of these Terms and Conditions which by their nature are intended to survive, including but not limited to clauses relating to intellectual property rights, personal data usage, indemnity, limitation of liability, and governing law, shall continue in full force and effect.

Warning

Any attempt to deliberately damage the promotional website ( namasteindiapromo@bigcity.in) or the information on the promotional website, to cause malicious damage or interference with the normal functioning of the promotional website, or to otherwise undermine the legitimate operation of this Offer may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, NIFL and BigCity reserves the right to seek damages to the fullest extent permitted by law. If the NIFL and BigCity suffers loss or incurs any costs in connection with any breach of these T&Cs or any other legal obligation by an entrant, the entrant agrees to indemnify NIFL and BigCity for those losses, damages, and costs.
